In other words, to be dischargeable, the return has to be finally due more than three years before the date of the petition to be dischargeable. So if you file the petition on April 16, 2005, a tax return due and filed on April 15, 2002 would be the first one eligible for discharge, and that would be the 2001 federal and state INCOME taxes.
