  • Private right to enforce includes damages and attorneys fees. Court can award treble damages if done willfully or knowingly. Note: Willful in civil setting is other than by accident.

• Criminal penalty is misdemeanor with up to 3 years and $10,000 fine but is not subject to 1 year statute of limitations.
